Haypp Limited, 13876184, operates the website www.northerner.com/uk (“The Website”). These terms and conditions (“Conditions”) are valid for every product order a consumer place on The Website.

By placing your order, you confirm that you have read, accepted, and agreed to comply with these Conditions. You also certify that you acknowledge the information about personal data and consent to the use of your personal data according to the Northerner privacy policy.

Northerner reserves the right to change these Conditions at any time. The Consumer Rights Act 2015 and the Data Protection Act 2018 as well as the General Data Protection Regulation apply to all purchases made by consumers on The Website.

Order and purchase agreement

By completing your order, you confirm that you have read and accepted these Conditions. The purchase agreement will only be concluded after your order has been confirmed by Northerner through a confirmation e-mail to the email address you provided when placing the order. Please note that you need to be at least 18 years old in order to be able to enter into a contract with Northerner and the contract can only be concluded with consumers with a delivery address in the above listed countries. Every change will be published on The Website and is valid from when you accept the Conditions through a new order.

Northerner’s service may only be used by individuals. Northerner reserves the right to decline an order in case Haypp suspects that the order is not intended for the Customer's private use. In case of suspicion that the Customer or the Customer's order does not meet Northerner's terms and conditions, or in case of suspicion of other types of irregularities or misuse of the service, Northerner reserves the right to decline, cancel or change a Customer's order. Furthermore, Northerner reserves the right to decline, cancel or change a Customer's order in case of suspicion of irregularities in connection to the Customer's use of a promotional gift or discount.

Age-limit

People under the age of 18 are not permitted to place orders at The Website. In order to be able to shop you need to verify your age when completing the purchase. In addition to confirming your age yourself, you as a cardholder need to be 18 years or older to complete the transaction.

An order made in another person’s name (falsification of a document), or in any other way that causes Northerner to risk a financial damage, will be reported to the authorities. Northerner reserves the right to refuse to carry out an order if irregularities or misuse of our order function are suspected.

Prices and fees

All prices and costs on The Website are charged in GBP (£), including the product prices throughout The Website and the shipping costs. Special fees may apply in case of an unredeemed package.

Before completing your order at the checkout, you have to choose the delivery method, after which the costs for your order, including shipping costs and applicable taxes, will be calculated.

Payment at the time of purchase (products and delivery) The card payment at The Website is carried out by Northerner’s payment provider Klarna. Klarna offers a range of payment methods, which are available at the checkout on the Website, including Visa & Mastercard. For further information, please refer to Klarna’s terms and conditions.

VAT

All products sold on this Website are subject to UK VAT (20%). Prices are shown including VAT. The VAT share of the order total is reported at checkout.

Northerner personal data handling

Personal data is handled according to the Northerner privacy policy. By ordering products at The Website you confirm that you have read and accepted the Northerner privacy policy and that the personal data you have stated is correct.

Delivery and delivery time

Northerner offers a range of different shipping alternatives depending on the size of the packaging, your place of residence etc. The shipping alternatives as well as the delivery time for each shipping alternative are further described in the checkout at the Website. When ordering through UPS (Standard and Express) you may need to present a valid identification at delivery. Thus, only the person placing the order at The Website should receive the order.

Unredeemed package/shipment

A package shipped according to any of our delivery alternatives will either be sent back to Northerner or discarded if you have not been able to redeem it. Unredeemed packages are usually not seen as an exercise of your rights of return.

Complaints and returns

If a product differs from the purchase agreement or does otherwise not correspond to the description provided by Northerner, you have the right to make a complaint about the product to Northerner.

In that case you’re welcome to make a complaint about your product. You can contact our customer service team to file a complaint here.

The right of complaint only includes faults at delivery (and not faults that for instance occurred due to the product’s expired shelf life or due to normal wear and tear). You need to notify Northerner about the fault when you discovered it. Northerner recommends you to carefully inspect products directly upon receiving them.

Depending on the type of product fault we may require you to provide photographic proof. Throughout the reclamation period you are required to retain original packaging, packing slip and the products in question.

Depending on the extent of the damage you will be able to get a replacement, remediation, or a price reduction. For further claims, exceeding the costs of the product, Northerner will handle claims in accordance with Consumer Contract Regulations.

Transport damages

In order for issues regarding transport damages to be resolved as quickly as possible, we kindly ask you to keep the product packaging for inspection. In order to be able to claim a reclamation on products you also need to prove your purchase from The Website, for instance through the order confirmation or receipt Northerner sent to the e-mail address you provided in connection with your purchase. We may also request photographic proof of damages.

Right of withdrawal and returns

When shopping online as a consumer, as a general rule you have a right of withdrawal of 14 days according to the Consumer Rights Act 2015. The right of withdrawal, however, does not apply to the purchase of products which are perishable goods with a limited shelf life, such as oral nicotine pouches.

Force majeure

Northerner is not required to fulfil the purchase agreement if the fulfilment is complicated due to an event outside of the reasonable control of Northerner (e.g. changed legislation, government measures, strikes, blockades, sabotage, war, terrorism, fire, floods, natural disasters, or other extraordinary events). Such circumstances also relieve Northerner from the obligation to pay compensation. If these circumstances last longer than two (2) months, both the consumer and Northerner have the right to cancel the purchase with immediate effect.

Price and product information on The Website

Northerner strives to make sure that all information provided on The Website is correct, but with reservations for limited availabilities and possible errors in pictures or writing, e.g. Northerner furthermore reserves the right to correct such errors at any time and change or update information. All pictures on The Website are intended as illustrations and cannot guarantee the exact appearance or condition of the product.

Reviews

By submitting a product review on The Website, you give Northerner the right to publish it on The Website and other channels and media. Northerner also reserves the right to not publish and/or delete submitted reviews.

The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.
